Giám định hàng hóa là gì?
Khi một hợp đồng thương mại quốc tế (hoặc nội địa) được ky kết, các bên tham gia ký kết hợp đồng đã quy định cụ thể và rất chặt chẽ những quyền lợi của mình trong nội dung. Tuy nhiên, quá trình thực hiện hợp đồng phải trải qua một thời gian từ khâu từ sản xuất, đóng gói, giao nhận, vận chuyển đến công trình, kho, nhà máy…nên luôn có tiềm ẩn nhiều rủi ro. Do đó, cho dù có loại trừ yếu tố chủ quan chính là gian lận thương mại, hàng hóa không phù hợp với hợp đồng, …thì vẫn còn nhiều yếu tố khách quan ảnh hưởng đến quyền lợi các bên và làm cho một số điều khoản trong hợp đồng không được thực hiện đầy đủ ví dụ: giao hàng không đúng thời hạn, giao hàng không đủ số lượng, khối lượng hoặ̣c giao hàng không đúng chủng loại–quy cách phẩm chất, v.v…
Mặt khác, hàng hóa muốn được chuyển giao từ người bán đến người mua phải trải qua nhiều khâu: vận chuyển, giao nhận, xếp dỡ, v.v… Các công đoạn nà̀y thường gây cho hàng hóa bị tổn thất hoặc ảnh hưởng đế́n chất lượng. Mỗi khi những vấ́n đề nêu trên xảy ra, tất yếu sẽ dẫn đến tranh chấp thương mại giữa bên mua với bên bán hoặc giữa bên mua, bên bán với bên thứ ba.
Khi có tranh chấp hay khiếu nại xảy ra, bên mua, bên bán thường căn cứ vào chứng thư giám định của một tổ chức giám định độc lập trung lập, không liên quan đến quyền lợi của các bên làm chứng cứ pháp lý quan trọng để giải quyết. Trong nhiều trường hợp, chứng thư giám định còn là chứng cứ pháp lý để khiếu nại bên thứ ba nếu hàng hóa bị tổn thất. Ngoài ra, chứng thư giám định còn là cơ sở để thanh toán quốc tế. Vì vậy, có thể nói giám định là một khâu quan trọng không thể thiếu trong lĩnh vực thương mại quốc tế.
